Terms of Use

By creating an account or using .fotos.site in any way, you agree to these terms in full. If you do not agree, do not use the service.

.fotos.site provides hosted photographer portfolio pages on subdomains of fotos.site. You are responsible for everything you publish on your page, including images, text, links, and contact information. You must ensure you hold all necessary rights and licences for any content you upload.

• You must be at least 16 years old to create an account and use .fotos.site.
• You must provide accurate registration information and keep it up to date.
• You must not share your account credentials with third parties.
• You must not use the service for any purpose that is unlawful or prohibited by these terms.
• Service features and pricing may be updated with reasonable notice.

These terms are governed by Swiss law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Zürich, Switzerland.

Content Policy

.fotos.site is a platform for professional photography portfolios. All content you upload must comply with applicable law and these guidelines. We reserve the right to review, remove, or restrict any content at our sole discretion.

Content ownership & license

You retain full ownership and all intellectual property rights in every photo, text, and other piece of content you upload. We do not claim any ownership over your work.

By uploading content, you grant us only a limited, non-exclusive, revocable license to host, store, and display that content for the sole purpose of operating your portfolio page. We will never use your content for our own marketing, sell it, sublicense it to third parties, or use it to train AI models, without your separate, explicit consent. This license ends immediately when you delete the content or your account.

Prohibited content

The following is strictly forbidden on .fotos.site:

• Explicit or pornographic material — any sexually explicit imagery, nudity intended to be sexual in nature, or content that would be classified as pornographic under applicable law.
• Content involving minors in a sexual context — absolutely prohibited and will be reported to the relevant authorities without exception.
• Graphic violence — images or descriptions depicting gore, gratuitous violence, or content designed to shock or disturb.
• Hate speech and discrimination — content that promotes or glorifies hatred, violence, or discrimination based on race, ethnicity, gender, religion, sexual orientation, disability, or any other characteristic.
• Intellectual property violations — content that infringes third-party copyrights, trademarks, or other intellectual property rights.
• Illegal content — any material that is unlawful under Swiss law or the law of the user's jurisdiction, including content that promotes illegal activity.
• Spam or misleading content — content designed to deceive visitors or misrepresent the nature of your portfolio.

Consequences of violations

If we determine that your content violates this policy, we may take one or more of the following actions without prior notice:

• Immediately remove or hide the offending content.
• Suspend or take your portfolio offline.
• Permanently terminate your account and cancel your subscription without refund.
• Report illegal content (in particular any content involving minors) to law enforcement.

To report content you believe violates this policy, email contact@fotos.site with the subject line "Content Report". We aim to review reports within 72 hours.

Billing & Cancellation

Free trial

New accounts receive a 14-day free trial. No charge is made during the trial period. At the end of the trial, your subscription begins automatically if you have entered a payment method. If no payment method is on file, your portfolio will go offline until a subscription is activated. Trials are non-renewable and may only be used once per account.

Subscriptions

Paid subscriptions are billed on a monthly or yearly cycle, depending on the plan you choose. Subscriptions renew automatically at the start of each billing period using the payment method on file.

Cancellation by you

You may cancel your subscription at any time from your account's billing settings. Cancellation takes effect at the end of the current billing period — you retain full access until then. We do not issue refunds for unused time in the current period.

Cancellation or suspension by us

We reserve the right to suspend or cancel your subscription and terminate your account at any time if you:

• Violate the Content Policy above.
• Violate these Terms of Use.
• Fail to pay your subscription fee after the payment provider's retry period has elapsed.
• Engage in fraudulent, abusive, or unlawful conduct.

In the event of termination for a policy violation, no refund will be issued for the current billing period. In the event of termination for non-payment, access is removed immediately.

Price changes

We may change subscription prices with at least 30 days' notice by email. If you do not wish to continue at the new price, you may cancel before the new price takes effect.

Account Termination & Data Deletion

Deleting your account

You may delete your account at any time from your profile settings. Upon deletion, your portfolio, all uploaded images, content blocks, and associated personal data are permanently removed from our systems. This action is irreversible.

If you have an active subscription, deleting your account does not automatically cancel the Stripe billing agreement. Please cancel your subscription first from the billing settings, then delete your account.

Termination by us

We may terminate your account and delete all associated data if your account has been suspended for a serious policy violation, has been inactive for more than 24 months with no active subscription, or if we discontinue the service with at least 30 days' notice.

Data retained after deletion

After account deletion, we may retain anonymised usage statistics and transaction records (e.g. payment receipts) for the period required by Swiss accounting and tax law (currently 10 years for financial records). No personally identifiable information is retained beyond what is legally required.

.fotos.site is operated as a private commercial service. Payments are processed by Stripe, Inc., a third-party payment provider. We are not liable for Stripe's processing of your payment data, which is governed by Stripe's Privacy Policy.

Privacy Policy

This privacy policy is provided in accordance with the Swiss Federal Act on Data Protection (nDSG) and, where applicable, the EU General Data Protection Regulation (GDPR).

Data we collect

• Account data — name, email address, phone number, and password (stored as a hash).
• Portfolio content — images, text, social links, and other material you publish on your page.
• Billing data — subscription status and plan. Payment card details are handled exclusively by Stripe and are never stored on our servers.
• Usage data — server logs, IP addresses, and session data, retained for a maximum of 90 days for security and debugging purposes, then deleted.

Visitors to your published portfolio

We do not collect or store any personal data about the people who visit your published portfolio page. We record only an anonymous, aggregate daily view count per site — no IP addresses, no cookies, and no identifying information about your visitors are captured by us. This means you do not inherit any data-protection obligations toward your own clients from using fotos.site to host your portfolio.

How we use your data

• To provide, operate, and secure the .fotos.site platform.
• To send transactional emails (account verification, billing receipts, service notifications).
• To enforce these terms and investigate potential violations.
• We do not sell or share your personal data with third parties for marketing purposes.

Sub-processors

We use the following third parties to operate fotos.site, each acting as a data processor on our behalf:

• hosttech AG (Switzerland) — web hosting and transactional email delivery. All hosting infrastructure and stored data is located in Switzerland.
• Stripe, Inc. — payment processing. Governed by Stripe's Privacy Policy.
• Google LLC — Google Analytics 4, only loaded with your explicit cookie consent (see Cookies below). Governed by Google's Privacy Policy.

Your rights

Under applicable data protection law, you have the right to access, correct, export, or request deletion of your personal data. You can download a full export of your account and portfolio data at any time from your profile settings, or exercise any of these rights by emailing contact@fotos.site. We will respond within 30 days.

You also have the right to lodge a complaint with a data protection supervisory authority. In Switzerland, this is the Federal Data Protection and Information Commissioner (FDPIC). If you are located in the EU, you may instead contact your local data protection authority.

Cookies

fotos.site uses session cookies required for authentication. These are strictly necessary and cannot be declined.

With your consent, we also load Google Analytics 4 (GA4) to measure aggregate visitor traffic — pages visited, session duration, and approximate location (country level). GA4 sets first-party cookies under the _ga prefix on the fotos.site domain. This data is processed by Google LLC under their privacy policy.

Analytics cookies are only loaded after you click Accept on the cookie banner. If you click Decline, no analytics cookies are set and no data is sent to Google. You can withdraw or change consent at any time by clearing your browser's cookies or local storage for fotos.site.
